    Eligibility Requirements

    To qualify for an E-2 visa, an applicant must:

    1. Be a citizen of a country that maintains a treaty of commerce and navigation with the United States;
    2. Invest a substantial amount of capital in a new or existing U.S. enterprise;
    3. Own at least 50% of the business or maintain operational control through a managerial position or other means;
    4. Show that the investment is active and at risk, generating employment or economic benefit;
    5. Demonstrate an intent to depart the U.S. when E-2 status ends (though renewals are unlimited).

    • Initial validity: Up to 2 years, renewable indefinitely in two-year increments.
      • Spouse and unmarried children under 21 may accompany the investor.
      • The spouse may apply for work authorization, and children may attend U.S. schools.
      • E-2 visa holders may travel freely in and out of the United States during validity.
