Eligibility Requirements
To qualify, you must:
- Be internationally recognized for outstanding achievements in a specific academic field;
- Have at least three years of experience in teaching or research; and
- Be entering the U.S. to accept a tenure or tenure-track teaching or permanent research position at a:
- S. institution of higher education, or
- Private employer with at least three full-time researchers and a proven record of research excellence.
Evidence Requirements (2 of 6)
You must provide at least two of the following:
- Major prizes or awards for outstanding achievement
- Membership in associations requiring exceptional achievement
- Published material written by others about your work
- Participation as a judge of the work of others
- Original scientific or scholarly research contributions
- Authorship of scholarly books or articles in internationally circulated journals
Employer Sponsorship
A U.S. employer must file Form I-140 on your behalf and demonstrate:
- The offer of a permanent teaching or research position, and
- The ability to pay the offered wage using annual reports, tax returns, or audited financial statements.
- No labor certification (PERM) is required for EB-1B petitions.
